Brigade Mondaine has been a registered trademark with the INPI since 2012 under number 3929948. MAISON BM is a limited liability company registered with the RCS of Paris under SIREN number 753 671 684. Intra-Community VAT FR63753671684 and EORI FR753671684.

The company publishes the websites old.brigademondaine.fr and brigademondaine.com (hereinafter "Brigade Mondaine").

These websites allow customers to purchase designer lingerie and accessories online. Placing an order implies full and unconditional acceptance of these Terms and Conditions of Sale.

Article 1. Products and contractual information

1.1 Products

The Products offered for sale are those displayed on the sites on the day of consultation, within the limit of available stocks. They comply with French legislation and applicable standards.

The photographs, text, graphics, and specifications are provided for informational purposes only and are not contractually binding. Brigade Mondaine shall not be held liable for any errors or changes.

1.2 Gift cards

The Gift Card is purchased just like any other product. By default, it is emailed to the purchaser or to the recipient specified at the time of order.

The validity period is one year from the date of purchase.

The Gift Card is non-transferable and can be used only once.

It is neither refundable nor exchangeable.

It is not subject to VAT.

1.3 Prices, VAT and customs duties

Prices are in euros and payable in euros. VAT is automatically calculated when the basket is validated.

The prices shown adjust automatically based on the country of delivery:

a. Customers in France and the European Union. Prices shown include tax. b. Customers in North and South America. Prices shown in U.S. dollars (USD), excluding tax. c. Customers outside the European Union. Prices are shown excluding tax in the currency of the delivery country, if applicable. Otherwise, prices are shown in euros

Since July 1, 2021, Brigade Mondaine has been applying the VAT reform via the OSS one-stop shop.

Shipments to the United States

Since August 29, 2025, all goods shipped to the USA have been subject to taxation from the first euro of declared value.

Shipments are made on a DAP (Delivered At Place) basis: import duties and taxes are not included in the price paid and are payable by the recipient directly to the carrier—such as FedEx—at the time of delivery.

For orders outside the European Union, import duties and taxes are set by the customs authorities of the destination country and are the responsibility of the Customer. Brigade Mondaine cannot be held liable for delays resulting from customs formalities.

1.4 Special and customized orders

Custom-made Products may take up to 75 business days to produce. These Products are not eligible for exchange, credit, or refund.

1.5 Promotional offers

Promotional offers cannot be combined; they are valid once per order and do not apply to shipping costs unless otherwise stated. They do not apply to Gift Cards or to Products marked as non-discounted. They are not retroactive and cannot be converted to cash.

1.6 Product safety

In accordance with the EU GPSR regulation, which has been in effect since December 13, 2024, Brigade Mondaine ensures transparency regarding the traceability of products both online and in its private boutique. The information displayed is provided by the brands and designers.

Article 2. Orders and payments

2.1 Identification

To place an order, you must create a customer account with your last name, first name, address, phone number, and email address.

2.2 Validation

Validation implies acceptance of the GCS. The sale is concluded upon full payment.

2.3 Online and in-store order payment

The Customer has several payment methods available to pay for their order. Payment is discreet and the brand name does not appear on bank documents.

PayPal (in one or more instalments)

Payment via PayPal allows you to pay by credit card (Visa, MasterCard, Amex, Carte Bancaire Nationale, Aurore, VPay, Cofinoga Privilège, Cofidis 4 étoiles, Discover, Maestro...), bank account or PayPal balance.

Brigade Mondaine does not charge any additional fees.

Payment in four installments with no additional fees is available via PayPal, subject to PayPal’s approval. If approved, the contract is entered into directly between the Customer and PayPal, which acts as the lender. Brigade Mondaine is not a party to this contract.

Payment is 100 % secure and encrypted (SSL and TLS). Bank details do not pass through Brigade Mondaine's servers.

If the order is canceled at the Customer's request, non-refundable PayPal fees will be deducted from the refund.

Mollie and Stripe (credit and debit cards)

Mollie and Stripe allow you to pay with debit and credit cards. Brigade Mondaine does not charge any additional fees.

Payments are secured by strong authentication and encryption (SSL, HSTS, AES-256). Our platforms are PCI DSS-certified, an international data security standard.

Brigade Mondaine never has access to banking data and does not retain any records of it.

If an order is canceled at the Customer’s request, any non-refundable Mollie or Stripe fees will be deducted from the refund.

Klarna (payment in 3 free instalments from €500)

Customers in the Netherlands, Belgium, Austria, Germany, Finland and France can pay in three instalments free of charge.

Expenses are fully covered by Brigade Mondaine.

The direct debit schedule and amounts are displayed during the transaction and sent by email to the customer.

Eligibility requirements: Adults and business professionals residing in metropolitan France who hold a Visa, Mastercard, or Carte Bancaire credit card issued in the applicable countries, valid for at least one month after the next billing date. Cards that require systematic authorization, prepaid cards, virtual cards, foreign cards, or credit cards are not accepted.

The customer authorizes the service provider to collect the sums due on the scheduled dates and accepts that the claim may be assigned to a third party.

The conditions of return are those of the present GTC. Gift Cards are not eligible for payment in instalments.

Cryptocurrency payments via UTRUST

Brigade Mondaine accepts payments in digital currencies via the UTRUST platform.

Payment is secure and simple—just scan a QR code. Transactions are fast and low-cost.

In the event of a cancellation or return of an order paid for in cryptocurrency, no refund in euros is possible. Only a store credit valid for one year will be issued. Non-refundable UTRUST fees will be deducted from the store credit.

SEPA bank transfer

Bank charges related to the transfer are the responsibility of the Customer. Brigade Mondaine must receive the net amount of the order.

The Customer must include their name and order number in the payment description. Shipment will be made only after receipt of payment.

Other payment methods

Depending on local availability: Giropay, iDEAL, Bancontact, EPS, Belfius Direct Net, KBC CBC, Przelewy24, Sofort Banking.

Gift cards

Brigade Mondaine Gift Cards can be used to pay for all or part of an order.

They are sent by email.

Validity: one year from the date of purchase.

The Gift Card is non-transferable and can be used only once.

If the order amount is less than the Card value, the balance is lost.

If the amount of the order is higher, the Customer completes the order by another means of payment.

Gift Cards can be combined with each other, with current promotions and with free delivery.

They are neither exchangeable nor refundable. Their purchase is not subject to VAT.

In-store payment

When making a purchase directly from the Paris 5 private store, payment is processed via an electronic payment terminal (EPT) using a credit card. Payments are immediate and secure.

2.4 Confirmation

A summary email is sent after payment.

2.5 Anti-fraud controls

Brigade Mondaine reserves the right to request supporting documentation before confirming an order.

2.6 Tax-free purchasing

Customers residing outside the EU and receiving deliveries there are billed without VAT.

Article 3. Delivery

3.1 Order preparation times

All orders validated before 12:00 pm, Paris time, are prepared and dispatched the same day.

Orders validated after 12:00 pm are processed the next working day.

These timeframes do not include weekends, holidays, or the annual summer closure period.

For Click & Collect orders, any order placed before 12:00 p.m. is prepared the same day and available for pickup starting at 2:00 p.m. Orders placed after 12:00 p.m. will be ready the next business day. Customers must wait until they receive the email confirming that their order is ready before coming to the private boutique.

3.2 Delivery times

Delivery times vary depending on the shipping method selected when placing the order.

For France: Standard shipping: 2 to 5 business days on average. Express shipping: 24 to 48 hours on average.

For international orders: Standard shipping: 2 to 10 business days on average. Express shipping: 48 hours on average.

These delivery times do not include weekends or holidays. They are provided for informational purposes only and may vary depending on the carrier, the destination, or exceptional circumstances beyond Brigade Mondaine's control.

3.3 Packaging

Discreet packages, products protected and wrapped in tissue paper. The brand name Brigade Mondaine is not mentioned on the package.

3.4 Customs and responsibilities

The customer must not accept a damaged or open parcel.

Customs duties and import taxes are set by the customs authorities of the destination country and are the responsibility of the Customer.

The Customer is solely responsible for complying with the laws in effect in their country regarding the importation of the purchased Products. Certain items may be subject to local restrictions or prohibited from import. For example, scented candles cannot be imported into the United States.

Hazardous or flammable products, explosive materials: explosives, hazardous substances, flammable items, and any product containing built-in batteries are subject to strict regulations for international transport. It is the Customer’s responsibility to verify whether these products may be imported into their country.

In the event that the Customer refuses the package, fails to pay the applicable duties and taxes, or if there is a local import ban, the costs charged to Brigade Mondaine to retrieve the package will be billed to the Customer.

If the package is destroyed by local authorities or returned to us, all costs associated with this process (shipping, customs, destruction, or repatriation) will also be charged to the Customer and deducted from any credit balance.

Brigade Mondaine cannot be held responsible in the event of blocking, seizure, prohibition or destruction of Products by local authorities due to regulations applicable in the country of delivery.

3.5 Damaged or incomplete products

The Customer must inspect the order upon receipt. Any discrepancies must be reported the same day or on the next business day to contact@old.brigademondaine.fr.

If the claim is valid, Brigade Mondaine will either exchange and reship the same product—subject to availability and at its own expense—issue a credit memo, or refund the purchase price of the product.

3.6 Non-delivery

The Customer has sixty (60) business days from the order date to report a non-delivery to Brigade Mondaine by email at contact@old.brigademondaine.fr.

All claims must include the order number and be accompanied by any relevant information needed to identify the shipment in question.

After this period, no claims can be accepted, and no inquiries can be made with the carrier beyond this period.

In the event of a late declaration, an investigation will be opened with the carrier. Processing times may vary depending on the carrier and destination. No commercial solution (reshipment, credit note or refund) will be offered until this investigation has been completed.

If the loss of the package is confirmed, Brigade Mondaine will, depending on the circumstances and subject to availability, either reship the package at its own expense, issue a credit, or refund the cost of the product.

3.7 Package unclaimed, refused or left at a relay point

The customer must collect the parcel within the time limit set by the carrier or the relay point.

In the event of failure to pick up the package, refusal of the package, an incomplete or incorrect address, or any other situation resulting in the package being returned to the sender, the return shipping costs and any reshipment costs will be the Customer’s responsibility.

If the parcel is returned to Brigade Mondaine in good condition, a credit note corresponding to the amount of the Products (excluding delivery costs) may be issued at the Customer's request.

On the other hand, if the parcel is damaged, opened, lost or declared unfit for resale on its return, no compensation, refund or credit note may be claimed by the Customer.

Brigade Mondaine assumes no liability for any loss, damage, or disappearance of a package after it has been made available to the Customer by the carrier (including at a pickup location or after a delivery notice has been left).

Article 4. Returns, retractions and refunds

4.1 Right of withdrawal

In accordance with the provisions of the Consumer Code, the Customer has fourteen (14) days from the date of receipt of the Products to exercise their right of withdrawal, subject to the legal and contractual exclusions set forth in these General Terms and Conditions of Sale.

The Customer may exercise this right:

• by using the online cancellation form, accessible via the «Cancellation» link located in the footer of every page on the Brigade Mondaine website; ;
• by email to contact@old.brigademondaine.fr; ;
• or by mail to MAISON BM, 4 rue du Fer à Moulin, 75005 Paris.

When the request is submitted via the online form, an acknowledgment of receipt is sent to the Customer as soon as possible in a durable medium. This acknowledgment of receipt states the content of the notice of withdrawal, as well as the date and time it was sent.

Upon receipt of the request, Brigade Mondaine will provide return instructions. No returns will be accepted without prior authorization from Brigade Mondaine.

4.2 Return conditions

Products must be returned within fourteen (14) days of notification of the decision to cancel, at the Customer’s expense and under the Customer’s responsibility.

Products must be returned in perfect condition for resale, unworn, unwashed, odor-free, in their original packaging, and accompanied by all accessories, instructions, and intact tags.

Any product showing signs of use, damage, an odor, damaged packaging, a broken seal, or any other condition that renders it unsuitable for resale may be refused.

4.3 Returns from outside the European Union

For returns shipped from a country outside the European Union, the Customer must complete a valid customs declaration and clearly indicate on the carrier’s form as well as on the package the words «Retour de marchandise» or «Return of goods,» specifying that this is a return and not a sale or purchase.

The customer is solely responsible for the information provided to the carrier and customs authorities.

If a failure to declare or an error in the declaration results in Brigade Mondaine being charged customs duties, import taxes, VAT, or administrative fees to retrieve the package, these amounts will be deducted in full from the credit or refund owed to the Customer.

Brigade Mondaine also reserves the right to refuse any package that incurs unreasonable charges or is not declared as a return.

4.4 Excluded products

The following items cannot be returned, exchanged, or refunded: lingerie that has come into contact with intimate areas, erotic accessories, intimate cosmetics, breast jewelry, foot accessories, stockings and tights, body and intimate jewelry, harnesses and jeweled bodysuits, BDSM accessories, latex lingerie, sale items, Outlet items, clearance items, limited editions, and gift sets. Products delivered in sealed packaging that have been unsealed after delivery cannot be returned, exchanged, or refunded when their return is excluded for reasons of hygiene or health protection, in accordance with Article L. 221-28 of the French Consumer Code.

Customized products or items made to order by our designers for Brigade Mondaine (Qrucifix, Una Burke, Crystal Eyez, FIGURE OF A, HERVÉ by Céline Marie, RE:STRICT) or identified as such on their product page cannot be returned, exchanged, or refunded. These items are manufactured or prepared specifically for each customer and are packaged in a special way. We recommend that you come try them on in-store.

4.5 Refunds and credit notes

Subject to compliance with these terms and conditions, Brigade Mondaine will issue a refund or, where applicable, a credit note corresponding to the returned Products within a maximum of fifteen (15) days from the date of receipt and inspection of the items.

The initial shipping costs and return shipping costs are not refundable, except in the case of an error attributable to Brigade Mondaine or a product determined to be defective.

In the event of a cancellation before shipment or a refund, any non-refundable payment processing fees charged by payment providers (PayPal, Stripe, Mollie, or any other provider) will be deducted from the refund amount.

Credit notes are valid for one (1) year from their date of issuance, may be used only once, cannot be split, and are non-refundable in cash. A credit note used for an order that is subsequently returned may be reissued only once.

4.6 Exchanges

We do not offer exchanges, except in cases of errors attributable to Brigade Mondaine. Any request for a different size, color, or style requires placing a new order.

4.7 Products available to order

Some products offered in the Brigade Mondaine store are available exclusively by special order. This information is clearly indicated on the relevant product page.

These products are subject to special shipping terms and a specific preparation or shipping timeframe, which is also indicated on the product page.

The Customer acknowledges that these Products may be subject to delivery terms that differ from Brigade Mondaine’s standard shipping terms, particularly due to their shipping location, weight, volume, or mode of transport.

The Customer has a maximum of six (6) hours from the time the order is confirmed to request its cancellation by email at contact@old.brigademondaine.fr.

After this period has elapsed, the order is considered definitively confirmed and has entered the preparation, manufacturing, or procurement process. It can no longer be canceled, modified, or refunded.

When the Product is shipped from a country outside the European Union, shipments may be made under the DDU (Delivered Duty Unpaid) Incoterm. Customs duties, import taxes, and any administrative fees in the destination country are the Customer’s sole responsibility.

Carriers used for these shipments may include DHL, FedEx, or any other comparable international carrier.

The shipping fees for these Products may be higher than Brigade Mondaine's standard shipping fees. They are clearly indicated before the order is confirmed.

By confirming their order, the Customer acknowledges that they have read and understood all the specific terms and conditions applicable to these Products and accept them without reservation.

Article 5. Shipping Costs

Shipping costs are calculated based on the geographic region, the selected shipping method, and the type of items ordered.

France Free Eco* shipping on orders of 100 euros or more (including tax). For orders below this amount, a flat fee of 10 euros applies. Express shipping: 20 euros.

European Union Free Eco* shipping on orders of 250 euros or more (excluding tax). For orders below this amount, a flat fee of 25 euros applies. Express shipping: 35 euros.

United States A flat fee of 50 euros. Free shipping is not available for this destination. This decision is due to U.S. customs regulations, whose requirements and associated fees significantly impact shipping costs.

Other international destinations Free Eco* shipping on orders of 500 euros or more (excluding tax). For orders below this amount, a flat fee of 35 euros (excluding tax) applies. Express shipping: 50 euros (excluding tax).

Eco Shipping uses the least expensive carrier and may include delivery to a pickup location. This shipping method is not insured, and delivery times may vary depending on the destination.

Some items, due to their weight or size, may incur additional delivery charges. This information is clearly indicated on the product sheet.

Article 6. Private store and VIP Events

6.1 Private appointments

The Paris 5 private boutique is accessible by private appointment for up to two people. Online booking recommended.

The private store is not accessible to minors.

Pets are not allowed in the private boutique.

Prices charged in private stores are strictly identical to those on the old.brigademondaine.fr website.

The customer can view all prices on a tablet provided during the appointment.

Purchases in private stores are firm and final.

Sales made in the Paris private boutique are finalized after the Customer has tried on and inspected the Products. They are not eligible for return, exchange, or refund, except in the case of a proven defect or non-conformity as defined by statutory warranties. The Customer acknowledges that they have been fully informed that any sale made in the private boutique is final.

6.2 VIP passes and deposits

The VIP Pass is a gift card valid for one year for an appointment in a private boutique. Non-breakable, non-refundable, non-exchangeable.

A deposit is required for Saturday VIP appointments. It will be deducted from your purchases on the day of the appointment. The deposit is non-refundable if cancellation is not notified by the day before at the latest.

6.3 Tax Refund and Eligibility Requirements

Tax-free shopping is available to customers residing outside the European Union for any in-store purchase of €100.01 or more (including tax) excluding fees, in partnership with FAIR TAX FREE. A service fee applies.

To be eligible, the customer must be 16 years of age or older, reside outside the European Union, and be staying in Europe for less than six months. The original passport must be presented at the time of purchase.

Items must be purchased for strictly personal use, and the purchase must be made entirely by the person whose name appears on the tax-free form.

Services and purchases made on old.brigademondaine.fr are not eligible for tax refunds. Tax refunds are only granted in accordance with the legal conditions in force.

Article 7. Personal data

The data collected is used for order processing and customer communication.

In accordance with the GDPR and the French Data Protection Act, the Customer has the right to access, correct, delete, object to, and transfer their personal data.

Article 8. Force majeure, legislation and intellectual property

8.1 Force majeure

In the event of force majeure that prevents delivery for more than one month, either party may cancel the sale. Brigade Mondaine will refund the price of the undelivered Product.

8.2 Local legislation and customs

The Customer must verify that importing the Products into their country is legal. The Customer is responsible for paying any customs and import duties.

8.3 Intellectual property

All content on these websites is protected by copyright and intellectual property laws. Any unauthorized reproduction is prohibited. The images have been edited and are not binding.

8.4 Applicable law and disputes

These Terms and Conditions are governed by French law. In the event of a dispute, an amicable settlement will be sought.

8.5 Consumer mediation

In accordance with Articles L. 612-1 et seq. of the Consumer Code, any consumer may, free of charge, seek the assistance of a consumer mediator to resolve amicably a dispute with Brigade Mondaine, after having first submitted a written complaint that has not been resolved.

The competent consumer mediator is the one appointed by FEVAD.
